These Terms & Conditions constitute a legally binding agreement made between you as an Individual User whether personally or on behalf of an entity (“User”,) and MBE Delhi Logistic Private Limited, doing business as MBE Delhi, concerning your access to and use of the www.mbedelhi.in as well as any other media form, media channel, linked, or otherwise connected thereto as a digital platform to access, manage and control information in relation to the MBE Delhi. 2. MBE Delhi and its digital platform allows users to get a quote through its portal to avail the Mailbox Services, more specifically mentioned on the website.
3. More particularly, MBE Delhi and its digital platform is an online venue where users may register themselves in order to get the Mailbox Services.
4. Details of specific services can be found on our website or provided during registering for the services. Unless explicitly stated otherwise, any new feature that enhances or supplements the Services will be considered part of MBE Delhi Logistic Pvt. Ltd. Services. We reserve the right to modify, suspend, or discontinue the Services (or any portion thereof) at any time, without notice, in the event of non-cooperation, non-payment, or unnecessary delays by the Users. The User agrees that neither they nor any related third party will hold the Company or its suppliers liable for any losses, damages, or consequences arising from such modifications, suspensions, or discontinuations of the Services.

User Representation

Payment Terms

2. You may be required to pay for purchasing to access our services. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the website. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We bill you through an online billing account for purchases made via the Site. GST and other applicable taxes in your respective country will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be made in USD, as we only accept payments in USD.

2. More particularly, for any purchase of services made by a customer from MBE Delhi, his/her request of cancellation and refund shall be governed by our “Cancellation and Refund Policy”. Under all circumstances, your purchase shall be subject to our Cancellation and Refund Policy.
Representations by the User
1. By using the MBE Delhi and its digital platform, you represent and warrant that all information you submit will be true, accurate, current, and complete and further you will maintain the accuracy of such information.
2. You hereby agree that our Platform shall be used for lawful purposes only and that you will not violate laws, regulations, ordinances or other such requirements of any applicable Central, State or local government or international law(s).

4. You represent that while communicating, posting, sharing content and while talking with our support executive and grievance redressal officer, you shall not use abusive and derogatory language and/or post any objectionable information that is unlawful, threatening, defamatory, or obscene. If doing so, we reserve the right to suspend the help support service and/or block your access and usage of our Platform, at any time with or without any notice.
Reviews and Submissions by Users
1. As a customer or user, you may be afforded with the opportunity to furnish reciprocal reviews. your reviews or ratings for MBE Delhi do not reflect the opinion of us. It is pertinent to state that each and every review posted on our platform is the personal opinion of the user only. We are a neutral platform, which solely provides a digital platform to users.
2. It is noteworthy that Reviews undergo no verification by MBE Delhi or its digital platform for accuracy, and consequently, there exists a possibility of inaccuracies or misleading content.
3. We reserve the right, at any time and without prior notice, to remove, block, or disable access to any Content, Review or Submission that we, for any reason or no reason, consider to be objectionable, in violation of the Terms & Conditions or otherwise harmful to the Services in our sole discretion. Further, we reserve the right to delete any images and pictures forming part of user’s Content, Review or Submission at our sole discretion.
Changes to the Terms

3. MBE Delhi and its digital platform owns or holds the Licenses to all Data and Marks on its Website or any other Digital Platform.
4. The content on the Platform (exclusive of all Submitted Content), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (“Data”) and the trademarks, service marks and logos contained therein (“Marks”), are owned by MBE Delhi. Other trademarks, names and logos on Platform are the property of their respective owners.
5. Data on the Platform is provided to you as is for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the MBE Delhi.
Prohibited Activities
1. Whether You have made a purchase or are simply browsing the Platform, you hereby agree to fully comply with all applicable laws and to not resort to any unethical practices while using the Website.
2. You may not access or use MBE Delhi or its digital platform for any purpose other than that for which we make MBE Delhi available. MBE Delhi or our digital platform may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.
3. As a user of the MBE Delhi platform, you agree not to:

  4. Make improper use of our support services or submit false reports of abuse or misconduct.
  5. Use the MBE Delhi in a manner inconsistent with any applicable laws or regulations.
Term and Termination
1. The agreement between you and our platform reflected by these Terms & Conditions remains in effect until either you or we terminate the agreement in accordance with these Terms.
2. Termination by MBE Delhi: You hereby acknowledge and agree that MBE Delhi in its sole and absolute discretion, has the right (but not the obligation) to terminate your access, block your email or IP address, cancel the MBE Delhi or otherwise terminate your access to or participation in the use of the MBE Delhi (or any part thereof), or remove and discard any Submitted Content on the Platform (“Termination of Service”), immediately and without notice.
3. We may also terminate this agreement immediately and without prior notice and stop providing access to the MBE Delhi if:
  1. you materially breach these Terms or Additional Legal Terms, or Policies;
  2. you violate applicable laws, or such action is necessary to protect the personal safety of MBE Delhi, its members, or third parties (for example in the case of fraudulent behaviour of a member).

Termination by You: Users reserves the right to terminate the utilization of the MBE Delhi and its digital platform at their discretion, either before engaging in any purchasing or availing of services provided by MBE Delhi and its digital platform. You may terminate this agreement at any time by sending us an email.

MBE Delhi and its digital platform’s decisions on Claims do not affect your contractual or statutory rights. We are not liable for any damages and shall not be involved in court proceedings related to such damages.

Our Role & Disclaimer
1. MBE Delhi provides an online platform or venue that enables users to avail the Mailbox Services being provided herein by providing required details. The user agree that our Services are provided on an “as-is” and “as-available” basis. MBE Delhi makes no warranties or representations, express or implied, regarding the accuracy, reliability, or availability of our Services.
2. MBE Delhi and its digital platform does not endorse or warrant user’s content or third party’s services. We are not responsible for internet outages, disruptions, or temporary platform unavailability. We may restrict platform availability for maintenance, security, or capacity reasons, considering involving parties’ legitimate interests.
Other Applicable Policies
1. We care about data privacy, security and smooth facilitation of the services by using our platform. By using MBE Delhi and its digital platform, you agree to be bound by our ‘Privacy Policy’, posted on the MBE Delhi and its digital platform along with this Terms of Use document. These all policies are in consonance with these Terms of Use.
2. You represent that you have read, understood and agreed to our all-above-mentioned applicable policies.
Dispute Resolution
1. If a dispute arises between you and MBE Delhi, in such case, you and MBE Delhi hereby agree to resolve any claim or controversy at law and equity that arises out of these Terms & Conditions through Mutual Discussion.
2. In case of non-resolution through Mutual Discussion, the dispute shall be referred to the Arbitrator appointed by MBE Delhi and finally resolved through Arbitration following the procedure mentioned in the Arbitration and Conciliation Act, 1996 and applicable rules.
Limitation of Liability
1. MBE Delhi and its digital platform will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or making a purchase using our website or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
2. In no event shall MBE Delhi, or its respective officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, suppliers, attorneys or agents, be liable to you for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantage).
Indemnification

You agree to defend, indemnify and hold harmless the MBE Delhi, its digital platform, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon a breach of any warranty, representation or undertaking in this Service Level Agreement, or arising out of a violation of any applicable law (including but not limited in relation to intellectual property rights, payment of statutory dues and taxes, claims of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights). This clause shall survive the expiry or termination of this Service Level Agreement.
Governing Law
1. These Terms shall be governed by and defined following the laws of India. MBE Delhi Logistic Private Limited and yourself irrevocably consent that the courts of India at New Delhi, India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
General Terms
1. Entire Agreement: The Terms and Conditions, together with the ‘Privacy Policy’ and ‘Terms of Use’, shall constitute the entire agreement between you and us concerning the Services of MBE Delhi and its digital platform.
2. Externals Links: This site may contain hyperlinks to external websites that are not maintained by or affiliated with the Company. These hyperlinks are provided as a convenience to users and do not imply sponsorship or endorsement by the Company. The Company has not reviewed all of these external sites and is not responsible for their content. Accessing these hyperlinks is at the Client’s own risk, and the Company makes no representations or warranties regarding the content, completeness, or accuracy of the hyperlinks or the sites they connect to.
